Terms and Conditions for Priceyourpainting (the “Terms & Conditions”)

Welcome to Priceyourpainting.com (“the Platform” or “Priceyourpainting”), the platform that allows you to obtain an economic valuation of your artworks (“the Work” or “ the Painting” or, in plural, “ the Works ” or “the Paintings ”).

Service Description
Priceyourpainting offers a valuation of the Work (“the Service”), uploaded by the user (“the User” or, in plural, “Users”), on the Platform, based on (i) descriptive data of the Painting, (ii) information concerning the costs of materials, (iii) its age, (iv) information about the creator of the Work, and (v) an aesthetic evaluation obtained through an algorithm devised by the creators of the Platform.
The service provided by the Platform to the Users is currently free of charge.
Platform Operation
Priceyourpainting processes the data of the Work provided by the User and, by summarizing these data and the aesthetic characteristics of the same, determines the final price of the Painting.
The specific data to be entered are:
- images related to the Painting;
- title of the Painting;
- a brief description of it with the possibility to narrate its history;
- length and height of the Work;
- type of paint used;
- cost of materials, enterable in Euros or other currencies;
- hours of labor employed in creating the Work;
- year of creation.
When entering the data of the Work, there is also the possibility, by clicking on “Add more information,” to insert features of the last painting sold.
To obtain the economic valuation of the Work, select the “Get estimate” option. Proceeding this way, a report will be obtained that provides the User with a brief description (“the Description”) of the Painting and a range of economic value within which the Painting uploaded to the Platform might be positioned.

In order to use the Service offered by the Platform, the User must create an account (“the Account”), by entering their personal information.
To create an Account, click on the option, at the top right of the Priceyourpainting web page, on “register/login”. The creation of only one Account per registered User is allowed.

To cancel their Account, the User must send a formal request via email to info@priceyourpainting.com. In the request, it is necessary to specify the details of the Account to be canceled and a brief reason for the decision, if the User wishes to provide it. The cancellation will be carried out by Priceyourpainting within 30 business days from the receipt of the request and confirmed via email to the User. After the cancellation, all personal information related to the Account will be permanently removed from our systems, except for those we are obligated to retain for longer periods according to applicable regulations. The User will no longer be able to access the Service through the canceled Account and will have to register again to use the Service in the future.
Acceptance and Modification of Terms and Conditions
These Terms and Conditions must be expressly accepted by the Users by clicking on the “accept” option which will be available to Users on the Platform after reading the Terms and Conditions.
Reading and accepting the Terms and Conditions are preliminary and essential for the use of the Service offered by the Platform.
These Terms and Conditions will be valid until the publication by the Platform of the new Terms and Conditions, which will be communicated to the Users via email, to the address provided by the User during registration. Users must expressly accept the new Terms and Conditions within 30 days from the date of notification. Such acceptance can occur through a click on a dedicated link available in the received email or through an acceptance mechanism present on the Platform.

In the absence of acceptance within the established term, the User's Account will be considered non-compliant and access to the Service will be temporarily suspended until the acceptance of the new Terms and Conditions. This measure is necessary to ensure that the use of the Platform always complies with the latest regulatory provisions and data management policies.
Statements and Warranties
1. Target Audience for the Service
  Priceyourpainting directs its activity only towards private individuals, and therefore, no Work can be uploaded to the Platform by a legal entity.
2. Cultural Interest of the Work
  The purpose of Priceyourpainting is solely to establish, ideally, a price range to identify the value of the Work. Therefore, any high value attributed to it by the Platform should not be considered as an indicator of cultural importance or as a basis for legal classification under any specific cultural heritage regulations.
3. Confidentiality Agreement
  The image of the Work and all information related to it will be kept confidential and will not be disclosed, directly or indirectly, to third parties without the prior written consent of the User owner. However, information may be disclosed that is:
  1. in the public domain;
  2. that Priceyourpainting is required to disclose to legitimate institutions under any legal or regulatory provision or if requested by the Competent Authority;
  3. to the employees, administrators, auditors, and professional consultants of Priceyourpainting provided they are bound by confidentiality obligations similar to those here.
4. Value of the Valuation
  The valuations provided by the Platform are approximate estimates, calculated based on the data provided and the aesthetic impact of the Work, and do not constitute an official valuation. The real value may vary based on a series of factors, including but not limited to the statements of the User, market conditions, authenticity, conditions of the Painting, and other variables.
  
  Priceyourpainting is not responsible for any discrepancies between the estimates provided by the Service offered and the actual value of the Painting in an actual sales context.
  Furthermore, Priceyourpainting assumes no responsibility for the untruthfulness of the information related to the Work uploaded to the Platform by the User.
Use of Information
The valuations obtained through the Service offered by the Platform are provided exclusively for informational use and should not be considered as financial, legal, or investment advice.
Users are responsible for any decision or action taken based on the information provided by the valuation service offered by Priceyourpainting.
Intellectual Property
All content present on https://priceyourpainting.com, including but not limited to texts, graphics, logos, images, audio clips, and videos, is the exclusive property of the Platform or its licensors and is protected by copyright and other international intellectual property laws.
Users are prohibited from reproducing, distributing, modifying, transmitting, reusing, publishing, or otherwise using such content without the prior written consent of Priceyourpainting or its legitimate copyright holders..
The software (“the Software”) used to calculate the value of the Users' Paintings on the website is the exclusive property of the Platform. All intellectual property rights, including copyright and patent rights, related to the Software are reserved to Priceyourpainting.
Users are granted a limited license to use the Software solely for the purpose of calculating the value of their own Works. The license does not include the right to distribute, modify, or exploit the Software for commercial or non-commercial purposes outside the website of Priceyourpainting.
User Restrictions
Users undertake not to attempt to decompile, disassemble, or reverse engineer the Software. Furthermore, the use of crawlers, robots, spiders, scrapers, or any other automatic device, program, algorithm, or methodology, or any similar manual process, to access, acquire, copy or monitor any part of the Platform or its contents, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or its contents, is strictly prohibited.

Users must not use any device, software, or routine to interfere or attempt to interfere with the proper functioning of the Platform or any transaction conducted on it, nor undertake any action that imposes an unreasonable or disproportionately large load on the Platform's infrastructure systems.
Any attempt to do so will constitute a violation of the intellectual property rights of the Platform and may be legally prosecuted. Additionally, the violation of these limitations may result in the immediate cancellation of the Account and the possibility of further legal action.
Applicable Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.
